D. Appeal of Decision
VI. Purpose and Procedures for the Student Conduct Code
The purpose of the student conduct code is to determine if a student has engaged in misconduct, and, in those cases in which it is determined that the student has engaged in misconduct, to impose appropriate sanctions. Baylor University employs the following procedures in fulfilling this purpose.

If the accused student believes that there is substantial evidence that the decision rendered was arbitrary or capricious or that the process afforded the student through the student conduct code was not followed, he or she may appeal to the vice president of student life, and the vice president of student life, or his or her designee, shall consider the request. The request shall be made in writing, shall specify the basis upon which the appeal is being made, and shall be submitted within three calendar days of the student receiving the decision. If the vice president finds substantial evidence exists that the decision rendered was arbitrary and capricious or that the process afforded the student through the student conduct code was not followed, he or she shall reverse the decision or shall request a new hearing.
If the student is dissatisfied with the response of the vice president, he or she may ask the president to consider the request. The request shall be made in writing within three calendar days of the student receiving the decision from the vice president of student life. In such a situation, the president shall review the record and confer with the vice president of student life and, based upon this review, if the president finds substantial evidence exists that the decision rendered was arbitrary and capricious or that the process afforded the student through the student conduct code was not followed, he or she shall reverse the decision or shall request a new hearing. Otherwise, the president shall affirm the decision. The decision of the president is final.
To ensure processing and tracking of an appeal, students are required to use the Appeal of Decision Form when submitting a decision appeal so that all necessary elements for the appeal are included. A request for appeal must be submitted within 3 calendar days of receipt of a hearing decision letter.
