Hazing Report - On or After September 1, 2019

In May of 2019, the Texas Legislature passed an amendment to the Texas Education Code (S.B. No. 38) that changed reporting requirements for hazing occurring on or after September 1, 2019. Hazing committed by organizations disciplined for or convicted of hazing that occurred before September 1, 2019 are required to be reported according to the prior requirements (which can be found at: Chapter 37 and Chapter 51). Organizations disciplined for or convicted of hazing that occurred on or after September 1, 2019 are required to be reported according to the new requirements (see below).

The Texas Education Code (Sec. 51.936) requires that Baylor University, not later than the 14th day before the first class day of each fall or spring semester, publish and distribute a summary of the Texas Hazing Law, subchapter F, Chapter 37 of the Texas Education Code, and a list of organizations that have been disciplined for hazing or convicted of hazing on or off the campus of the institution during the preceding three years. In compliance with this law, Baylor provides the following information:

Baylor's Statement on Hazing is a summary of the Texas Hazing Law. Copies of the entire hazing law enacted by the Texas legislature are available from the Judicial Affairs office or the hazing bill may be viewed in its entirety at the "Texas Legislature Online" website at: https://www.legis.state.tx.us/. Information about hazing may be found in the Texas Education Code, Chapter 37, sections 37.151 through 37.158 and Chapter 51, section 51.936.

Phi Gamma Delta (FIJI)

General Description of Incident: Chapter members forced consumption of food, alcohol, and/or drugs to new member candidates
Violations of Institution's Code: Organization Hazing Offense
Findings: Chapter members organized the activity
Sanctions:
  1. 2 members removed from active membership; 4 members resigned National affiliation
  2. All 6 referred to Student Conduct Administration for any individual action deemed appropriate
  3. Graduate Trusteeship held full chapter review, interviewing every current member.  13 additional members were removed from active status.
  4. Local chapter placed on university probation for one year - through November 18, 2020

Alpha Tau Omega (ATO) - Spring 2020

General Description of Incident:
  1. Requiring new members to perform a task that could result in physical harm
  2. One new member harmed
Violations of Institution's Code: Organization Hazing Offense
Findings: Responsible
Sanctions:
  1. Be on university probation for one year, until February 20, 2021
  2. Chapter members responsible for hazing incident removed from membership and also referred to Student Conduct for individual meetings
  3. Chapter social probation for remainder of spring 2020 semester
  4. At least one executive officer required to attend hazing prevention institute in summer 2020 with follow-up report to Student Activities and presentation t the chapter.

Sigma Chi
Name: Sigma Chi

General Description of Incident:
  1. Hazing of new member class at off-campus residence of fraternity members on Bid Day; required class to stand in rows while members sprayed with sparkling grape juice and CO2 canister.
Violations of Institution's Code:
  1. Organization Hazing Offense
  2. Hosting an unregistered fraternity-related event at a private residenc
  3. Hosting an off-campus event without the advisor's knowledge or presence
Findings: Responsible
Sanctions:
  1. University probation until November 5, 2021; length of probation term reviewable by Student Activities in November 2020
  2. Chapter officers must participate in a tailored risk management training as prescribed by Student Activities, scheduled by April 1, 2020, and completed by end of spring 2020 semester
  3. No social or brotherhood events off campus for the remainder of the spring 2020 semester, including mixers, formals, and recruitment
  4. No form of recruitment in the fall 2020 semester

  1. Hazing of new members in relation to:
    1. Requiring new members to stay at a specific residence(s) for extended timeframes without the choice to leave
    2. Sleep Deprivation
    3. Calisthenics
    4. Physical Brutality (fighting, physical confrontations)
Violations of institution's Code: Organization Hazing Offense
Findings: Responsible
Sanctions:
  1. New members will be initiated as members with no further new member education activities.
  2. At least one executive officer will attend the Hazing Prevention Institute in June2021.
  3. Officer(s) who attend(s) the institute will provide a hazing prevention training to the organization membership
  4. Fall 2021 new member education will be limited to a maximum of 4 weeks.  All new member activities will occur on campus and any off-campus new member activities are prohibited.  At the outset of the new member education experience the organization will provide hazing education information (including reporting options) to all new members.
  5. The organization will be placed on a probationary period for new member education activities through the end of the fall 2022 semester.

General Description of Incident:
  1. Organization intended to cause mental stress through new member education activities through cursing, yelling, providing misleading information, threatening languate, and hosting evetns with hostile atmosphere

Findings: Responsible
Sanctions:
  1. The organization will complete an organizational culture review process
  2. The organization is prohibited from hosting Diadeloso in spring 2022 semester.
  3. At least one executive officer will complete a hazing prevention education course/seminar
  4. Officer(s) who attend(s) the institute will provide a hazing prevention training to the organization membership
  5. The organization will complete an audit of events and traditions to ensure compliance with university policy and Texas hazing law
  6. The organization will continue to be prohibited from hosting new member education until the organizational culture review process, hazing prevention training, and audit of events and traditionsare completed to a satisfactory level.
  7. Once the organization completes requirements to resume hosting a new member education program, and approved advisor(s) will observe all formal new member education activities in person during the first implementation of the revised new member education program

General Description of Incident:

  1. Organization incorporated calisthenics within the new member education experience that subjected new members to an unreasonable risk of harm and/or adversely affected the physical health and/or safety of students.
Violations of Institution's Code: Organization Hazing Offense
Findings: Responsible
Sanctions and Remedies:
  1. The organization will complete the proposed support and development plan provided by the national office, with enhancements, which includes:
    1. The organization is placed on disciplinary probation until May 31, 2023.
    2. The organization is placed on social suspension until December 31, 2022.  The organization’s social suspension does not include Float, All-University Sing, intramurals or other activities that benefit the Baylor community or promote positive, internal chapter development (i.e., brotherhood retreat).
    3. The organization will be managed by a committee of alumni members until chapter deficiencies are corrected.
      1. Alumni members will directly advise chapter officers.
      2. At least one alumni member will attend each chapter meeting during the spring 2022 and fall 2022 semesters.
      3. Alumni members will select and appoint all nine chapter officers to serve through November 2022.
      4. Alumni members will facilitate an officer retreat for training, analysis, and strategic planning.
      5. All members of the organization will meet with alumni members to determine if they will remain an active member or be removed from the organization.
      6. Alumni members will facilitate an educational session on risk management and social event management for all members of the organization resulting in the organization developing a social event management plan.
      7. Alumni members will facilitate an educational session on values-based recruitment, hazing prevention, and the new member experience resulting in the organization developing a recruitment plan and new member education plan.
    4. At least four members will attend the national organization’s emerging leaders conference for leadership training and development.
    5. An organization officer will attend the national organization’s leadership institute for intensive leadership and officer training.
    6. All nine chapter officers will attend the national organization’s officer training conference for position specific officer training.
  2. All members of Kappa Alpha Order will complete a specific hazing prevention course assigned by the Department of Student Activities and paid for by the chapter.
  3. Following the successful completion of the hazing prevention course, the organization will initiate the current new member class during an agreed-upon process which limits the new member education activities to a five-day program consisting of only educational activities in an on-campus location to be led by alumni members.

  1. Organization incorporated sleep deprivation through repeated late night activities within the new member education experience that subjected new members to an unreasonable risk of harm and/or adversely affected the physical health and/or safety of students.

Sanctions and Remedies:
  1. The organization in partnership with the national organization, will conduct a membership review to confirm student members commit to participate in the fraternity experience in alignment with university expectations and policies.
  2. All members of Pi Kappa Phi will complete a specific hazing prevention course assigned by the Department of Student Activities and paid for by the chapter.
  3. The organization is placed on social suspension until December 31, 2022.  The organization’s social suspension does not include Float, All-University Sing, intramurals or other activities that benefit the Baylor community or promote positive, internal chapter development (i.e., brotherhood retreat).
  4. The organization will complete the proposed remedial action plan provided by the national office, with enhancements, which includes:
    1. The organization is placed on disciplinary probation until May 31, 2023.
    2. Following the successful completion of the membership review and hazing prevention course, the organization will initiate the current new member class during an agreed-upon process which limits the new member education activities to a five-day program consisting of only educational activities in an on-campus location.
    3. 90% of organization members complete an educational workshop focused on dignity, respect, and bystander intervention.
    4. Organizational leadership will develop behavioral expectations for new member events and activities:
      1. All members and new members will receive education on these expectations.
      2. All members will agree to abide by these policies or will be unable to participate in new member activities and events.
    5. Two delegates will attend the national organization’s leadership conference.
    6. Six delegates will attend the national organization’s conference for chapter officers.
    7. A national organization representative will participate in monthly calls with organization members throughout probationary period to ensure the organization is compliant with risk management policies.
    8. The organization will review new member education program with national organization representative in advance of hosting new member education activities and events.
    9. The organization will recruit a contracted advisor for a period of 10 months.
    10. An organization representative will meet monthly with Student Activities staff member until the conclusion of the probationary period.
    11. The organization will host all new member education activities and events in an on-campus location until the conclusion of the probationary period.
