Hazing Report - On or After January 1, 2022

In May of 2019, the Texas Legislature passed an amendment to the Texas Education Code (S.B. No. 38) that changed reporting requirements for hazing occurring on or after September 1, 2019. Hazing committed by organizations disciplined for or convicted of hazing that occurred before September 1, 2019 are required to be reported according to the prior requirements (which can be found at: Chapter 37 and Chapter 51). Organizations disciplined for or convicted of hazing that occurred on or after September 1, 2019 are required to be reported according to the new requirements (see below).

The Texas Education Code (Sec. 51.936) requires that Baylor University, not later than the 14th day before the first class day of each fall or spring semester, publish and distribute a summary of the Texas Hazing Law, subchapter F, Chapter 37 of the Texas Education Code, and a list of organizations that have been disciplined for hazing or convicted of hazing on or off the campus of the institution during the preceding three years. In compliance with this law, Baylor provides the following information:

Baylor's Policy on Hazing is a summary of the Texas Hazing Law. Copies of the entire hazing law enacted by the Texas legislature are available from the Judicial Affairs office or the hazing bill may be viewed in its entirety at the "Texas Legislature Online" website at: https://www.legis.state.tx.us/. Information about hazing may be found in the Texas Education Code, Chapter 37, sections 37.151 through 37.158 and Chapter 51, section 51.936.

Kappa Alpha Order
Name: Kappa Alpha Order

General Description of Incident:

  1. Organization incorporated calisthenics within the new member education experience that subjected new members to an unreasonable risk of harm and/or adversely affected the physical health and/or safety of students.
Violations of Institution's Code: Organization Hazing Offense

Sanctions and Remedies:
  1. The organization will complete the proposed support and development plan provided by the national office, with enhancements, which includes:
    1. The organization is placed on disciplinary probation until May 31, 2023.
    2. The organization is placed on social suspension until December 31, 2022.  The organization’s social suspension does not include Float, All-University Sing, intramurals or other activities that benefit the Baylor community or promote positive, internal chapter development (i.e., brotherhood retreat).
    3. The organization will be managed by a committee of alumni members until chapter deficiencies are corrected.
      1. Alumni members will directly advise chapter officers.
      2. At least one alumni member will attend each chapter meeting during the spring 2022 and fall 2022 semesters.
      3. Alumni members will select and appoint all nine chapter officers to serve through November 2022.
      4. Alumni members will facilitate an officer retreat for training, analysis, and strategic planning.
      5. All members of the organization will meet with alumni members to determine if they will remain an active member or be removed from the organization.
      6. Alumni members will facilitate an educational session on risk management and social event management for all members of the organization resulting in the organization developing a social event management plan.
      7. Alumni members will facilitate an educational session on values-based recruitment, hazing prevention, and the new member experience resulting in the organization developing a recruitment plan and new member education plan.
    4. At least four members will attend the national organization’s emerging leaders conference for leadership training and development.
    5. An organization officer will attend the national organization’s leadership institute for intensive leadership and officer training.
    6. All nine chapter officers will attend the national organization’s officer training conference for position specific officer training.
  2. All members of Kappa Alpha Order will complete a specific hazing prevention course assigned by the Department of Student Activities and paid for by the chapter.
  3. Following the successful completion of the hazing prevention course, the organization will initiate the current new member class during an agreed-upon process which limits the new member education activities to a five-day program consisting of only educational activities in an on-campus location to be led by alumni members.

Pi Kappa Phi

  1. Organization incorporated sleep deprivation through repeated late night activities within the new member education experience that subjected new members to an unreasonable risk of harm and/or adversely affected the physical health and/or safety of students.

Sanctions and Remedies:
  1. The organization in partnership with the national organization, will conduct a membership review to confirm student members commit to participate in the fraternity experience in alignment with university expectations and policies.
  2. All members of Pi Kappa Phi will complete a specific hazing prevention course assigned by the Department of Student Activities and paid for by the chapter.
  3. The organization is placed on social suspension until December 31, 2022.  The organization’s social suspension does not include Float, All-University Sing, intramurals or other activities that benefit the Baylor community or promote positive, internal chapter development (i.e., brotherhood retreat).
  4. The organization will complete the proposed remedial action plan provided by the national office, with enhancements, which includes:
    1. The organization is placed on disciplinary probation until May 31, 2023.
    2. Following the successful completion of the membership review and hazing prevention course, the organization will initiate the current new member class during an agreed-upon process which limits the new member education activities to a five-day program consisting of only educational activities in an on-campus location.
    3. 90% of organization members complete an educational workshop focused on dignity, respect, and bystander intervention.
    4. Organizational leadership will develop behavioral expectations for new member events and activities:
      1. All members and new members will receive education on these expectations.
      2. All members will agree to abide by these policies or will be unable to participate in new member activities and events.
    5. Two delegates will attend the national organization’s leadership conference.
    6. Six delegates will attend the national organization’s conference for chapter officers.
    7. A national organization representative will participate in monthly calls with organization members throughout probationary period to ensure the organization is compliant with risk management policies.
    8. The organization will review new member education program with national organization representative in advance of hosting new member education activities and events.
    9. The organization will recruit a contracted advisor for a period of 10 months.
    10. An organization representative will meet monthly with Student Activities staff member until the conclusion of the probationary period.
    11. The organization will host all new member education activities and events in an on-campus location until the conclusion of the probationary period.

Alpha Kappa Psi

General Description of Incident: Organization incorporated humiliating and demeaning activities within the new member recruitment interview experience that adversely affected the mental health of a student.

Sanctions:
  1. The organization is placed on probation for new member education activities through December 31, 2023. 
  2. The organization will implement sanctions outlined within the internal report provided by the national office, with enhancements, which includes:
    1. The organization will incorporate a review and approval process with the student organization advisor and national chapter representative for the format and content of the interview and new member education program.
    2. Organization officers will complete relevant national organization trainings prior to implementing new member education.
    3. New members will complete relevant new member education trainings.
    4. Limiting the next two new member education programs to half of the maximum allowed for by the national organization, not to exceed five weeks as per Baylor University policy.
    5. All members of the organization will complete an inclusivity programming course hosted by the national organization.  Attendance will be tracked and 95% of membership is required to complete the training by December 31, 2023.
  3. All members of Alpha Kappa Psi will complete a specific hazing prevention course assigned by the Department of Student Activities and paid for by the chapter.  Attendance will be tracked and 95% of membership is required to complete the training by August 31, 2023.
  4. All members of Alpha Kappa Psi will complete a review of Baylor University Statement on Hazing policy presented by the Department of Student Activities.  Completion will be tracked and 95% of membership is required to complete the training by August 31, 2023.
  5. Following the successful completion of training requirements listed above, Alpha Kappa Psi may host recruitment and new member education activities after the organization’s new member education program is reviewed and approved by the Department of Student Activities in accordance with university policy.
  6. All new members will complete an educational curriculum provided by the Department of Student Activities regarding hazing, alcohol, and sexual misconduct.  Attendance will be tracked and 95% of new members are required to complete the training in advance of participating in new member education activities hosted by Alpha Kappa Psi.

Sanctions:

1. A commitment to restructuring the New Member process alongside the faculty advisor, the District Grand Master, the guidelines in the Brothers-In-Action 4-week plan, and the Associate Director for Fraternity and Sorority Life by April 19th, 2024.

2. A commitment to hosting a chapter-wide Zoom call with the District Grand Master in order to thoroughly review the Kappa Sigma Code of Conduct by Friday, April 19th, 2024.

3. A commitment to the immediate removal of the responsible members from the Fraternity, with the list of these names and verification that the national organization has been notified of these removals provided to Student Activities by January 31st, 2024.

4. Suspension of all new member activities until August 26, 2024.

5. Probation of social activities until August 26th, 2024. The only exception is that Kappa Sigma will be required to host 3 educational tabling sessions during the Spring 2024 semester to be completed by Friday, April 19th, 2024.

6. Completion of an online Alcohol Awareness and Education course, presented by Prevent Zone to be paid for by the Fraternity and completed by all members by March 18th, 2024.

7. Completion of a Bystander and Intervention training in person with the Title IX office by all new members to be scheduled and completed by March 18th, 2024.

8. Attendance by all members of an in-person Connect training with the Assistant Director of Student Involvement.

  9. Chapter leadership must do a complete review of findings with the brotherhood.
  10. SAE must host a meeting with the chapter to educate the members on University policy concerning events, event registration, alcohol, and hazing.
  11. Executive Board must meet with the Associate Director for Fraternity and Sorority Life to discuss SAE's new member education plan and review strategies for mitigating risks.
